This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review carefully.

YOUR RIGHTS

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

  • You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. Ask us how to do this.

  • We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

    payment, or our operations.

    • We are not required to agree to your request, and we may say “no” if it
      would affect your care.

  • If you pay for a service or health care item out-of-pocket in full, you can
    ask us not to share that information for the purpose of payment or our
    operations with your health insurer.

    • We will say “yes” unless a law requires us to share that information.

GET A LIST OF THOSE WITH WHOM WE'VE SHARED INFORMATION​

  • You can ask for a list (accounting) of the times we’ve shared your health
    information for six years prior to the date you ask, who we shared it with,
    and why.

  • We will include all the disclosures except for those about treatment,
    payment, and health care operations, and certain other disclosures (such as
    any you asked us to make). We’ll provide one accounting a year for free but
    will charge a reasonable, cost-based fee if you ask for another one within
    12 months.

GET A COPY OF THIS PRIVACY NOTICE

  • You can ask for a paper copy of this notice at any time, even if you have
    agreed to receive the notice electronically. We will provide you with a paper
    copy promptly.

CHOOSE SOMEONE TO ACT FOR YOU

  • If you have given someone medical power of attorney or if someone is your
    legal guardian, that person can exercise your rights and make choices about
    your health information.

  • We will make sure the person has this authority and can act for you before
    we take any action.

FILE A COMPLAINT IF YOU FEEL YOUR RIGHTS ARE VIOLATED

  • You can complain if you feel we have violated your rights by contacting us
    using the information on page 1. 

  • You can file a complaint with the U.S. Department of Health and Human
    Services Office for Civil Rights by sending a letter to 200 Independence
    Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting
    www.hhs.gov/ocr/privacy/hipaa/complaints/.

  • We will not retaliate against you for filing a complaint.

YOUR CHOICES

THIRD PARTY ACCOUNTS

You will be able to connect your BeyondMed account to third party accounts. By connecting your BeyondMed account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature. 

INTERNATIONAL USERS

The Service is controlled, operated and administered by BeyondMed from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the BeyondMed Content accessed through https://www.beyondmedcare.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations. 

INDEMNIFICATION

You agree to indemnify, defend and hold harmless BeyondMed, its managers, its employees, agents, directors, members, managers, shareholders, officers, representatives, assigns, parents, predecessors, and successors from and against any and all loss or damage, including any and all indirect, incidental, special, consequential or exemplary damages, expenses (including reasonable attorney's fees), liabilities, claims, or demands whatsoever arising out of or related to your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations, any failure of technology or equipment in connection with the provision of telemedicine, whether or not any such loss, damage, expense, liability, claim, or demand arises from or relates to the BeyondMed's negligence. BeyondMed reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Beyond|Med in asserting any available defenses. 

 

ARBITRATION

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to there Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions. 

 

CLASS ACTION WAIVER

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitration and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECT GIVE AN/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and BeyondMed agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

 

LIABILITY DISCLAIMER

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE IN ACCUSERS OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. BEYONDMED AND/OR ITS SUPPLIERS  MAY MAKE IMPROVEMENT AND/OR CHANGES IN THE SITE AT ANY TIME.

TERMINATION/ACCESS RESTRICTIONS

BeyondMed reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Georgia and you hereby consent to the exclusive jurisdiction and venue of courts in Georgia in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. 

You agree that no joint venture, partnership, employment, or agency relationship exists between you and BeyondMed as a result of this agreement or use of the Site. BeyondMed's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of BeyondMed's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by BeyondMed with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provisions will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. 

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Beyond|Med with respect to the Site and it supersedes all prior contemporaneous communications and proposals, whether electronic, oral or written, between the user and BeyondMed with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English. 

CHANGES TO TERMS

HIPAA WEBSITE SECURITY

Beyond|Med Telehealth takes calculated steps to ensure technical, physical and administrative information transmission and storage safeguards. As medical professionals who handle sensitive health information, we, are considered a “covered entity,” held to the highest standards of upholding data privacy policies. We are committed to protecting your data in accordance with the Health Insurance Portability and Accountability Act of 1996 Privacy Rule (HIPAA). Please be advised that we apply appropriate and effective methods to de-identify you from your Personal Health Information (PHI) once it is collected; however, although the risks are very small, it is not zero, and there is a possibility that the protected data could be linked back to the identity of the patient to which it corresponds.

 

WHAT IS HIPAA?

The Health Insurance Portability and Accountability Act became law in August 1996. Known as HIPAA, it was designed to set in motion a series of widespread measures focusing on simplifying the processing and distribution of medical information, improving the portability of health Insurance, giving patients access to medical information, and protecting patient data that is stored, processed, or transmitted across public networks.

WHAT'S A "HIPAA-COMPLIANT" WEBSITE?

A website that is "HIPAA Compliant" is one that provides the physical and technological security measures required to ensure that any patient information, physician-patient correspondence and other sensitive information remains secure,

confidential and unable to be digitally intercepted or otherwise accessed by outside parties. In short, a "HIPPA-compliant" website means all required steps have been taken to keep private information private - It's a "safe" website.

IS THE BEYOND|MED TELEHEALTH WEBSITE “SAFE?"

Yes, the Beyond|Med Telehealth website is safe. Since our website (https://www.beyondmedcare.com) can transmit and/or store patient information, we have ensured that our website complies with all current HIPAA guidelines. We are pleased to reassure people that our Internet security measures are continually updated and monitored and that all patient results transactions are protected and safe.

 

HOW IS MY INFORMATION PROTECTED?

Encryption: We use HTTPS validated by an SSL. HTTPS is a security protocol that helps your site stay secure. This protection is validated by an SSL certificate. Hyper Text Transfer Protocol Secure (HTTPS) is the secure protocol through which your browser communicates with sites.

 

When you transmit personal information to us, we encrypt it using  a Secure Socket Layer, the industry-standard encryption technology. Encryption provides a secure means to protect your information as it passes over the internet to our servers.

 

An SSL Certificate, or Secure Sockets Layer, allows Beyond|Med site visitors to view our site over an HTTPS connection. It secures the connection between your browser and ours. As a general rule, you can see if a site has an SSL certificate if the URL begins with https:// instead of http://. When using HTTP sites, any data that is transferred can potentially be accessed or manipulated by attackers. However, when using HTTPS sites, like Beyond|Med’s website, data is encrypted and authenticated and therefore secured. A site URL that has not enabled an SSL certificate shows an “i” icon in Google Chrome. If a site URL shows a closed lock icon in Google Chrome, that is an indication that its SSL certificate has been enabled, which is the case for Beyond|Med Telehealth.

  • Beyond|Med site visitors' information is encrypted, and therefore more secure.

  • Beyond|Med users can feel more comfortable paying for services and sharing their personal information online when visiting our secure site.

  • As a precaution: Google Chrome now displays warnings anytime you visit a site that is not using HTTPS. Therefore, if that site is not secured, you will get a warning message.

 

BROWSER SECURITY

We’d like for you to be able to safely and securely use our site on your personal device(s). Keeping that in mind, some older browsers don’t support the high security standards required by SSL certificates.

IP ADDRESSES

We do not trace our visitor’s IP addresses through our site. We also do not use external tools to provide that feature, such as Google Analytics.

 

ANALYTICS

Our analytics provides aggregate information that does not identify an individual, but an entire group of people. For instance, we quantify how many new clients versus returning clients we have within a certain period, without any personal data being attached to a single visitor.

 

POLICIES AND PROCEDURES

We continuously evolve and update our internal information security policies and our business continuity and disaster recovery plans. We perform risk assessment, security audit, and system-test activities on an ongoing basis.
